Registration Agreement Terms ("Agreement")

Before you register, please read the following conditions:
1. Terms of Service
(1) Acceptance of terms
Ownership and the operating license of the China.org.cn community ("Site") belong to China.org.cn. The Site will provide Internet service in conformity with this Agreement and related regulations. Specific service of the Site, including but not limited to the forum, China Answers, China Wiki and City Guide, will be provided by China.org.cn based on the practical situation. Please read this Agreement carefully before you register. By using this service, you agree to be bound by all terms of this Agreement and its amendments.
(2) Amendments of Agreement
The Site reserves the right to amend the terms and conditions of the Agreement at any time. The Site reserves the right to modify, cease and end part of or the entire service. China.org.cn is not responsible for users if it stops the service. All amendments shall supercede this Agreement and be effective regarding your use of the Site immediately upon posting. Guidelines and rules, which may be posted and modified from time to time, are part of the Agreement. By continuing to use this service after the posting of notices regarding such changes, you agree to be bound by such changes.
2. Service Regulations
The laws and regulations below will be observed by users:
(1) Users shall abide by laws and regulations of the People's Republic of China and assume the legal responsibility for their behavior. The Site will stop providing service to users if their behaviors are considered against laws and regulations.
(2) Users who are not living in China should also abide by laws and regulations in their country or region.
User name
(1) Names of party and state leaders, real names of other people, stage names, pen names and titles are not allowed to be registered as user names.
(2) Titles of party and government organizations and other organizations are not allowed to be registered as user names.
(3) Same or similar names as other users are not allowed.
(4) Vulgar and obscene names are not allowed to be registered as user names.
(5) Ambiguous and misleading names and names with grotesque marks are not allowed to be registered as user names.
User information
(1) The user agrees to provide true, accurate, current and complete information about himself.
(2) The user agrees to maintain and promptly update his registration data to keep it true, accurate, current and complete.
Member account, password and security
(1) The user will receive a password and account designation upon completing the registration process. The user is responsible for maintaining the confidentiality of his password and account and is fully responsible for all activities that occur under his password or account.
(2) The user should not let others use his account and password. The user agrees to immediately notify China.org.cn of any unlawful use of his account or other security problems. China.org.cn is not responsible for the unlawful use if it is caused by the user's negligence or hackers. China.org.cn reserves the right to cancel the user's account and terminate the service if he violates related rules and regulations or terms in the Agreement.
(3) The user understands and agrees that China.org.cn assumes no responsibility for the timeliness, deletion or misdelivery of or failure to store any user communications or personalization settings.
Forbidden conducts
The user agrees to abide by the laws and regulations of the People's Republic of China. The user is entirely responsible for all content he uploads, posts or otherwise makes available via the Site. He agrees the content he posts on the Site will not include:
(1) Content going against fundamental principles in the constitutional law and/or content forbidden by other rules and regulations;
(2) Content that will harm national security, betray state secrets, overthrow the government and/or spoil the unity of China;
(3) Content that will damage national interests and/or attack the Communist Party and government and leaders of the Communist Party and government;
(4) Content that will incite ethical hostility and discrimination and/or undermine national unity;
(5) Content that incites unlawful assembly, unlawful tongs, unlawful parades and/or unlawful demonstrations, and/or content that organizes activities in the name of illegal organization;
(6) Content that damages national policies on religion and/or trumpet superstition and feudalistic superstition;
(7) Content that spreads rumors, upsets the public and/or destroys social stability;
(8) Content that spreads obscenities, pornography, gambling, violence and/or terrorism, or that instigates others to crime;
(9) Content that goes against traditional virtues, public virtues, the ethics of the Chinese people and/or socialist spiritual civilization;
(10) Content that trumpets racial discrimination and/or destroys state, national and regional unity;
(11) Content that infringes upon the portraiture rights, name rights, reputation rights, privacy rights and other rights of other persons;
(12) Content that repeats and posts huge amounts of information maliciously;
(13) Content that posts various advertisements without the approval of China.org.cn;
(14) Content that spreads destruction to other computers (including computer viruses) and/or content that interferes with or disrupts China.org.cn or servers or networks connected to China.org.cn;
(15) Content that contains personal attacks or insults and/or that decries, backbites or threatens others, or content that damages the legal rights of others.
The user acknowledges, consents and agrees that China.org.cn has the right to modify and cancel any posted information. China.org.cn also has the right to freeze the user's account temporarily or cancel his account permanently if the content by the user violates terms in this Agreement. The user also acknowledges, consents and agrees that China.org.cn reserves the right to ascertain legal responsibility and that the system log of the Site will be used as evidence.
3. Privacy policy
For all legal users of the Site, China.org.cn will protect the user's privacy and will never publicize, edit or reveal the user's personal information and the information preserved in the Site without the user's authorization, except in the event of one of the following situations:
(1) The user has disobeyed or is disobeying rules and regulations or terms in the Agreement;
(2) A related legal department requests information to be put on record;
(3) To protect the rights, property and safety of individuals and the public;
(4) To assist the claim of the third party whose rights were infringed upon;
(5) To protect common interests of users and society;
(6) To protect the legal rights of China.org.cn;
(7) To get specific authorization by users in advance; or
(8) To be in line with other related requirements.
4. Intellectual property rights and other related rights of the Site
(1) With respect to content the user submits or makes available for inclusion on publicly accessible areas of China.org.cn: The user grants China.org.cn the worldwide, royalty-free and non-exclusive license to use, copy, reproduce, modify, publish, translate, make descendible products of, spread, perform and/or display part or whole of the content and to incorporate part or whole of the content into other products, media or technology.
(2) The words, software, videos, pictures, content in e-mail and advertisements, the China.org.cn logo and other related logos are protected by laws of property rights, including copyright, trademark and patent laws. The user is not allowed to copy, publish, reprint, broadcast, adapt and/or compile these content for commercial purposes.
(3) The user agrees that the words, pictures and background music he uploads have legal authorization and will not infringe on the legal rights of a third party. Otherwise the user will bear legal responsibility for his behavior. The user agrees not to upload, publish and/or send any inside or confidential information, including business secrets, the private information of other people or other content that infringes on trademark, patent and/or copyright rights.
5. Disclaimer
(1) The service, which involves Internet and mobile communications, may be affected by some unstable factors. Therefore, the service may be interrupted or unable to meet the user's requirements because of, but not limited to, causes of accidental forces, computer viruses, assaults by hackers, unstable system, the user's position, close downs, GSM network, Internet, and/or communication lines. The user understands and agrees to bear the above risks as China.org.cn does not guarantee a timely, secure and error-free service. China.org.cn is not responsible for the loss of data and termination of service caused by accidental forces beyond the control of China.org.cn.
(2) Any material downloaded or otherwise obtained through the use of the Site is accessed at the user's own discretion and risk. The user will be solely responsible for and hereby waives any and all claims and causes of action of damage to the user's computer system, Internet access and/or download or display device, as well as any loss of data that results from the download of any such material.
(3) The Site may provide links to other World Wide Web sites or resources. The user acknowledges and agrees that China.org.cn is not responsible for the availability of such external sites or resources and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. The user further acknowledges and agrees that China.org.cn shall not be responsible or liable, directly or indirectly, for any damage or loss caused or allegedly caused by or in connection with use of or reliance on any such content, goods and/or services available on or through any such sites or resources.
(4) The user agrees to protect interests of the Site and other users. The user agrees that he is responsible for any damage or loss to China.org.cn or other users caused by his use of the service. The user understands that the Site shall not be liable to him for any punitive, indirect, incidental, special, consequential and/or exemplary damages.
(5) The user agrees that the Site shall not be liable to him for the behavior of third parties that infringe on the user's rights, including using, modifying, educing, downloading and transshipping information from the Site.
6. Termination
(1) The user agrees that China.org.cn may immediately terminate, limit his access to or suspend his account and access to service for the cause of breaches or violations of the terms of service or other incorporated agreements or guidelines, and when China.org.cn thinks it necessary.
(2) The user agrees that China.org.cn has the right to take back, modify and terminate second-level domain and space which include, but is not limited to, the domain and space the user registers via China.org.cn.
(3) The user understands and agrees that China.org.cn can take such measures without notifying users in advance and that China.org.cn bears no responsibility for such measures for users and third parties.
7. Conclusion
The execution and explanation of the Agreement and settlement of disputes apply to laws and regulations of the People's Republic of China. Any part of the Agreement that goes against the laws and regulations of the People's Republic of China should be re-explained according to laws. The Agreement and other guidelines or rules of the Site form the complete agreement. China.org.cn reserves the right to modify the agreement and owns the authority for the interpretation of the agreement. The user and China.org.cn agree that disputes between the two parties should be resolved by consultation. Otherwise, either side can appeal to court.
