Ruling upheld in Chinese tycoon's property cases

A provincial high court on Monday upheld a ruling in favor of a jailed Chinese businesswoman in two property dispute cases that had been ongoing for six years.

The Zhejiang Provincial Higher People's Court sustained the decision made by the Jinhua City Intermediate People's Court on Nov. 29 concerning Wu Ying, the jailed owner of Bense Holding Group, said Tang Xuebing, a spokesman for the provincial high court.

Tang said the rulings of the civil cases were made in accordance with the law and there was no evidence of client-judge collusion or irregularities despite the disputes being unresolved since 2006.

In 2006, through filing two civil lawsuits, a man named Bi Jian secured a court settlement to sell properties under Bense to two individuals -- Hu Ziren and Liu Xianfu.

In 2008, the Jinhua court revoked the settlement but both parties appealed.

In November's trial, the court threw out the lawsuits filed by Bi, saying he represented Bense "without authorization."

Observers said the civil case victory will help Wu prevent losses that might have been incurred from the planned "cheap sale" of her properties by Bi.

But the latest development will not affect Wu's suspended death penalty for financial fraud -- a criminal offense.

Wu is serving a prison sentence for cheating investors out of 380 million yuan (60.2 million U.S. dollars) from May 2005 to January 2007 in private lending scams.

Wu was initially sentenced to death in 2009. As her case sparked heated debate over the country's fund-raising system. She got her sentence reduced to death with a two-year reprieve in May this year. Endit
