System of lists of government powers

Lists of government powers are those that catalogue the functions and powers of China's executive branch at different levels. These lists are available for public scrutiny.

At its Third Plenary Session in November 2013, the 18th CPC Central Committee decided to put in place a transparent system whereby the powers of local governments and their departments are catalogued so as to ensure that these powers are exercised according to the law. At its Fourth Plenary Session in October 2014, the 18th CPC Central Committee decided to further implement the transparency initiative in order to eliminate any room for personal profiteering.

This initiative is crucial to China's effort to upgrade its governance system and capacity. It is designed to ensure that no public authority exercises or assumes any power that is not granted by law.

权力清单制度

权力清单指中国各级政府根据法律法规的规定,以清单方式对政府及政府部门行使的职能、权限进行列举,形成行政权力事项目录,对外公布并接受社会监督。

中国共产党十八届三中全会《决定》提出,“推行地方各级政府及其工作部门权力清单制度,依法公开权力运行流程。”十八届四中全会《决定》进一步提出,“推行政府权力清单制度,坚决消除权力设租寻租空间。”

推行权力清单制度是中国推进国家治理体系和治理能力现代化的一项基础性工作,它要求政府部门法无授权不可为,不得法外设定权力。
