Criminals aged 75 and older will not be subjected to capital punishment unless they are guilty of the "extreme brutality" of murder, according to the latest draft amendment to the China's criminal law, Xinhua reports. The stipulation, included in the second draft of the eighth amendment to the law, was submitted on Monday to the National People's Congress (NPC) Standing Committee, the country's top legislature. The first draft released in August proposed to spare those over 75 from the death penalty and has since been revised after concern over the possibility of gangs employing the elderly to commit serious crimes, or the elderly simply committing murder from their own motivations. 新华社消息,最新的刑法修正案草案规定,已满75周岁的老人犯罪不适用死刑,但以特别残忍手段致人死亡的除外。本周一,刑法修正案(八)草案二审稿提交全国人大常委会审议。今年八月公布的草案初审稿曾规定,已满75周岁的老人若犯罪可免予死刑。但后来考虑到可能会有犯罪集团雇用老人实施特别严重的犯罪,且可能会有部分老人故意实施犯罪,遂对该规定作出修改。
The latest draft also says gang leaders and organizers will face a set term of at least seven years and up to 15 years, and specifies conditions for reducing sentences, stating that leniency can be shown to those whose confessions help minimize losses.

此次审议的草案还规定,黑社会头目及组织者将被处七年以上﹑15年以下有期徒刑,并对减轻刑罚事宜作了具体要求,明确表示对如实供述自己罪行﹑最大限度减少损失的犯罪嫌疑人可宽大处理。
