Rule of law is an essential task for China (Part II)

The incumbent Central Committee of the Communist Party of China (CPC) is holding its fourth plenary session on Oct. 20 - 23 in Beijing. The session centers on the issues including the rule of law. In an interview with China.org.cn, Dong Yawei, the deputy director of the Political Party Teaching and Researching Office of the Party Building Department, Party School of the CPC Central Committee, discusses issues such as how to push forward the rule of law. His main points have been presented in a two-part series. The following is the second part:

China.org.cn: In 2004, the Chinese government issued the Implementation Outlines for Comprehensively Advancing Administration by Law, which aims to establish a government under the rule of law by 2014. Now, after ten years, do you think the target has been accomplished?

Dong Yawei: Firstly, it is a great achievement that China has been able to develop from a traditional system of ruling by people to a modern rule of law era, and discuss the issue rationally. This shows that CPC has already noticed the importance of the rule of law and has matured after learning from positive and negative experiences since 1976.

Secondly, a socialist legal system with Chinese characteristics has been essentially set up. On the one hand, in our ideas, cognition and theory, we have already accepted a sophisticated legal system; on the other, our country has established a relatively complete legal framework overall and in various fields in society.

Thirdly, our country has built an essential political system and institutions. From legislation to law enforcement, to legal supervision, the CPC has set up a complete mechanism, which is the crucial foundation for China to discuss and implement the rule of law.

Fourthly, with the development of opening up and modern socialist democracy, Chinese people have been learning to accept the idea of the rule of law. Although there exist illegal phenomena in society, there is effective social order, law enforcement, and administrative efficiency.

Based on this, there is already a solid foundation for the rule of law system. However, a prominent problem for our legal system currently is that some local governments and departments do not administrate fully by the law.

"Power overshadowing the law" is still a problem in some local governments, and has become a stumbling block in building the country's legal system. To some extent, the problem is associated with the imperfection in China's market economic system.

Since the market economy was first introduced in Chinese society, a range of problems have emerged, for example, how to protect the property rights of private companies, how to exercise public property rights, how to regulate the market economy, how to narrow the gap between the rich and the poor, and how to perfect the social security system. All these problems are due to be discussed and dealt with. In a word, in the socialist market economy, the CPC should learn to manage the relationship between its leadership and the rule of law.
