Former ousted President Hosni Mubarak who was transferred last week to a military hospital for medical treatment is slowly recovering. Mubarak, who is serving a life sentence in Torah prison, fractured several ribs in a bathroom fall and also had a build-up of fluid in the membranes lining his lungs.

Mubarak's lawyer Fareed El deeb, who refused to appear on our cameras, told us he is getting better. A medical report prepared at the prosecutor's request was the trigger for his transfer from Torah.

Hassan Abo Eleneen, international arbitrator, said, "The prosecutor decision carries some sympathy from the law point of view. According to the law, the prosecutor is responsible for the poisoned health and it is a correct decision. It sympathizes with an old man who has 83-84 years."

Mubarak is serving a life sentence for his role in the killing of protesters during the uprising that led to his resignation in February 2011 ending his three-decade rule More than 850 people died in the January uprising

According to a prosecution source, Mubarak will return to jail after treatment. A Cairo court has decided it will rule on the appeal of Mubarak on 13 January, a move that could lead to Mubarak being retried. According to law experts, a re-trail will drop the previous verdict.

Hassan Abo Eleneen, said, "I predict that the verdict will be accepting the appeal and hence order a retrial. In this case the previous verdict will be ruled out and his imprisonment will not be lawful. If this is the case Mubarak should be free temporarily."

On the other side, a fact finding team discovered that Mubarak was able to watch through live feeds the violence during the uprising.

An issue he denied in the previous trial and might worsen his situation.

The former strongman continues to fight his illness while seeking a re-trial which might add more jail time if new charges appears and even worsen the life sentence.
