New regulations on property registration come into effect

China has put into effect new regulations on property registration, marking a substantial step forward towards the establishment of a unified national real estate registration system.

The 35-article regulations outline property management requirements, including on registration institutions, registry books, procedures and information sharing and protection. The Chinese Ministry of Land and Resources is responsible for monitering property registration overall, while local governments will set up institutions to implement the process.

An accurate and complete record will be required of registration information including natural conditions of the land, titles, rights and limitations. All this must be logged electronically where possible.

The new registration rules cover ownership of collective properties, housing, forests and farm land, as well as contracted land management rights, and rights to the use of construction land, homesteads and maritime areas.

"The new property document of title shall be given in line with the regulations, in places which have completed institutional integration. In places where institutional integration has not been completed, the original document of title must be given until the authorizing bodies complete the integration. No institution or organization can compel citizens or enterprises to change to the new document of title." said Wang Guanghua, chief of China's Bureau of Property Registration.
