The Measures for the Administration of Filing an IP Address

(Adopted at the ministerial affairs meeting of the Ministry of Information Industry of the People's Republic of China on January 28, 2005, are hereby promulgated, and shall come into force on March 20, 2005.)

Article 1. The Measures are formulated in order to strengthen the administration of filing an IP Address, to ensure the safety of the Internet, to guarantee the fundamental interests of Internet users, and to promote the healthy development of China's Internet culture.

Article 2. Those within China that acquire IP addresses directly from international Internet registries, such as the Asia Pacific Network Information Center, or those that allocate IP addresses to other entities and individuals shall be governed by these Measures.

Article 3. Those that acquire IP addresses directly from international Internet registries, such as the Asia Pacific Network Information Center or those that allocate IP addresses to other entities and individuals shall be considered the first IP address allocation institution .

Those that acquire IP addresses directly from the first IP address allocation institution not only for private use but also for allocation to other users in addition to itself shall be considered the second IP address allocation institution (the rest of the lower-level IP address assignment institutions can be deduced by analogy ).

Article 4. The state shall administer the filing of the IP address allocation.

Article 5. The Ministry of Information Industry of the People's Republic of China (hereafter referred to as MII) shall supervise the filing of the IP address for the basic telecommunications operators , public welfare Internet units, and the China Information Center for the Internet.

The telecommunications bureaus under the people's government of the province, autonomous region, or municipality directly under the central government (hereafter referred to as provincial telecommunications bureaus) shall be responsible for the filing of the IP address.

Article 6. The MII will establish and administer a national IP address database, and will establish and adjust the IP address information that is to be filed;

Each provincial telecommunications bureau must supervise the registration of the IP address allocation institutions within its respective jurisdiction.

Article 7 Each IP address allocation institution must submit the information on the IP address in electronic format in accordance with the measures for filing an IP address on the website designated by the MII.

Article 8. Each IP address allocation institution must submit the IP address information truthfully and fully during the filing of the IP address.

Article 9. Each IP address allocation institution must submit information on the IP address in electronic format to a website designated by the MII within 20 business days after acquiring such IP address;

Article 10. Each IP address allocation institution shall submit all information regarding any changes in an IP address in electronic format to a website designated by the MII within 5 business days

Each IP address allocation institution shall submit any information regarding changes in the contact or the way to contact the unit.

Article 11. Information on the IP address of the basic telecommunications operators are required to be submitted by the basic telecommunications operators of the group company (parent company) and their provincial company (provincial branch).

Each basic telecommunications operator of the group company (parent company) shall submit the information on the application, use, and allocation of the IP address to the provincial company (provincial branch) in accordance with the Measures . Each basic telecommunications operator of the provincial company (provincial branch) shall submit for the record the information on the application, use, and allocation of the IP address to the provincial company (provincial branches) and the affiliated company (branches) in accordance with the Measures .

Article 12. Public welfare Internet management institutions such as the China Education and Research Network, the China Science and Technology Network, the China International Economy and Trade Net, and China Great Wall shall submit for the record the information on the application, use, and allocation of the IP address..

Article 13. The IP address allocation institution that also supplies network access services shall submit the IP address information of the institution's clients within 5 working days after the client's access to its network;

Article 14. Each IP address allocation institution shall establish an IP address management system .

Article 15. Each IP address allocation institution shall notify all relevant subsidiaries to submit the IP address information for the record.

Article 16. The personnel of the MII and the provincial telecommunications bureaus are required to keep confidential the IP address information submitted for the record by the IP address allocation institutions.

The personnel of the MII and the provincial telecommunications bureaus shall not supply others with the IP address information submitted for the record by the IP address allocation institutions unless the law and administrative regulations provide otherwise.

Article 17. Those violating Articles 8, 9, 10, or 13 of the Measures shall be ordered by the MII and the provincial telecommunications bureaus to make a correction within a certain time limit; when this time limit is exceeded, they shall either be warned or fined up to 10,000 yuan or both.

Article 18. Those that do not establish an IP address management system in violation of Article 14 of the Measures shall be ordered to make a correction within a certain time limit by the MII and the provincial telecommunications bureaus; when this time limit is exceeded, they shall be either warned or fined between 5,000 and 10,000 yuan or both.

Article 19. Those that acquired IP addresses directly from international Internet registries, such as the Asia Pacific Network Information Center, and those that allocated IP addresses to other entities and individuals before the Measures went into effect shall complete the formalities for filing within 45 business days of the Measures taking effect..

Article 20. The Measures shall come into force on March 20, 2005.

Addendum:

The following IP address information must be submitted for the record :

1. Basic information on the units on record, including the name, address, nature, serial number of the Permit for the Operation of Telecommunications Business, the name of the contact person, telephone number, email address, and so forth.

2. Information on the origin of the IP addresses of the units on record, including the name of the institution from which the IP address was allocated, the total quantity of IP addresses, and the beginning and ending address codes of each IP address range, and so forth.

3. Allocation usage information of the units on record including :

(1) IP address information for the private use of the unit, including the total quantity of IP addresses, the beginning and ending address codes of each IP address range, the usage mode of each IP address, the gateway of each IP address, and the address of the gateways;

(2) unallocated IP address information, including the total quantity of IP addresses, and the beginning and the end of the address code of each IP address range;

3.) IP address information for allocation to other users, including the basic information on the allocated users (including the user's name , the category and the affiliated industry of the unit, the detailed address of the unit , the name, the telephone number, and the email address of the contact person, the total quantity of assigned IP addresses, the beginning and ending of the address codes of each IP address range, the IP addresses' gateways, the address of the gateways, and, the usage mode of the IP address, and so forth.

4. Information on the Internet access users who prepare the IP addresses by themselves,, including the basic information ( the user's name , the category and the affiliated industry of the unit , the name, telephone number, and email address of the contact person, the total quantity of IP addresses, the beginning and ending of the address codes of each IP address range, the IP addresses of the gateways, the addresses of the gateways, and the usage mode of the IP address and so forth.
