Work of the Supreme People's Procuratorate


  On March 10, 2004, Procurator General Jia Chunwang reported on the work of the Supreme People's Procuratorate to the Second Session of the 10th NPC.

In 2003, procuratorates at various levels approved the arrest of 764,776 criminal suspects of various kinds and initiated public prosecution against 819,216 people. Of these, arrestees and defendants on charge of economic crimes numbered 19,222 and 21,440, respectively. The Supreme People's Procuratorate strengthened supervision over registration of economic cases, propelling related departments to file 1,541 such cases.

More efforts were made in crackdown on corruption. The procuratorates placed 39,562 cases of various job-related crimes on file for investigation, involving 43,490 people. Proceedings were initiated against 26,124 people involved in 22,761 cases. The efforts helped retrieve more than 4.3 billion yuan in direct economic losses. Major criminal cases involving corruption, taking bribes and embezzlement of public funds handled by procuratorial organs numbered 18,515, and 123 of them involved at least 10 million yuan each. A total of 2,728 officials at or above the county/section level, 167 at or above the prefectural level, and four officials at the provincial/ministerial level were investigated.

Supervision on civil and administrative procedures were intensified, with focus placed on infringements upon public interests, as well as actions of perverting justice for bribes and harming the rights and interests of migrant workers and laid-off workers. In this regard, procuratorates across the country protested against the rulings of 13,120 cases and advanced proposals for re-hearing and re-prosecution on 3,316 cases. Procuratorial organs also made concerted efforts to deal with cases of extended detention, correcting all such cases involving 555 people before the end of July 2003.

Experiment with the "people's supervisor" system was pushed forward. Selected through recommendation of government departments, social organizations, public service units and enterprises, people's supervisors oversee procuratorial organs in their investigation of job-related crimes where decisions of canceling prosecution or arrest are made or criminal suspects reject decisions of arrest. The system is being tried in 10 provinces, autonomous regions and municipalities. So far, 4,944 people have been recommended to serve as people's supervisors, who have intervened in 493 cases. They agreed with the procuratorial organs on 462 cases and disagreed on 31. After discussions, the relevant procuratorial committees had adopted the propositions of the people's supervisors and reversed their former decisions on 21 cases.
