Rules for Transferring Suspect Criminal Cases Issued

A regulation signed by Premier Zhu Rongji requires enforcement departments of administrative and laws to transfer suspect criminal cases timely to public security organization. Public security organization should start procedures within three days.

To enforce the legal system, China's State Council has issued a regulation concerning enforcement departments of administrative and laws in transferring suspect criminal cases.

As of July 17, while handling illegal economic and social activities, enforcement departments of administrative laws should transfer suspect criminal cases to corresponding public security organizations in a timely manner in accordance with the country's related criminal and economic laws, says the regulation signed by Premier Zhu Rongji on July 4.

Along with the case files, related evidence, examination reports, appraisals, and a list of materials seized in the cases should also be handed over to the public security organizations.

The regulation says the public security organizations should sign on return receipt within 24 hours after receiving the cases.

Within three days, the public security organizations should place the cases on file for investigation and prosecution. If there is no requirement for criminal responsibility, the cases should be returned to the enforcement departments of administrative laws.

The supervision on such cases transferring should be taken by relevant procurators, the regulation adds.
