Domestic Violence
Dear China Internet Information Center:

Is domestic violence (physical abuse by a Spouse or boyfriend) a problem in the People's Republic? If so, are there safe places for the women to go to and are there services available to them? What are the laws pertaining to domestic violence? Can an abused women get a Court order removing the abuser from the home?

Dear Carolyn:

In my opinion, domestic violence is a real problem in some places in China as violence against women has become a global epidemic.

In China, if a woman is physically abused by her husband, she may go to a local women’s federation or to the All-China Women’s Federation (ACWF) for help. The local federation will try to resolve the dispute through mediation. If that does not work, they will refer the case to the courts. A man who is found guilty of domestic violence will be punished according to the Criminal Law, the Law of Criminal Procedures, or local regulations on domestic violence.

The All-China Women’s Federation is an organization dedicated to the advancement of Chinese women of all ethnic groups in all walks of life. It represents and protects women’s rights and interests, and promotes equality between men and women.

Also, according to the 49th article of the Constitution of the People’s Republic of China, marriage, families, mothers and children are under state protection.

Finally, China has revised the Criminal Law and the Law of Criminal Procedures to make new provisions for protecting the rights and interests of women. Some provinces also have promulgated local regulations on domestic violence when such incidents appear to be on the increase, causing damage to both families and social stability.
