Proclamation of the Beijing Organizing Committee for the Games of the XXIX Olympiad

(November 11, 2005)

The Mascots of the Organizing Committee for the Games of the XXIX Olympiad (refer to Beijing 2008 Olympiad Mascots, hereafter the Mascots, including the image and name of the Mascots, and the same below) were revealed today. This Committee makes the following proclamation regarding the protection of the intellectual property rights of the Mascots:

1. In accordance with the Regulations on the Protection of Olympic Symbols, this Committee is the right holder of the Mascots, and it has handled the procedure to put the Mascots as Olympic Symbols on the record at the State Administration for Industry and Commerce.

2. The application for the Mascots trademark registration was submitted to the Trademark Bureau of the State Administration for Industry and Commerce today, with this Committee as the applicant.

3. This Committee holds the intact copyright of the Mascots, and has submitted the application for the Mascots  copyright registration to the Copyright Bureau of Beijing today.

4. In cooperation with the International Olympic Committee, this Committee has handled related procedures for the protection of the intellectual property rights of the Mascots in Hong Kong, Macao, Taiwan and foreign countries.

5. No organization or individual may use the Mascots for commercial purposes (including potential commercial purposes, and the same below) without the authorization of this Committee. In accordance with the Regulations on the Protection of the Olympic Symbols, use of the Mascots for Commercial purposes means the use of the Mascots in following manners:

5.1 The use of the Mascots in goods, packages or containers of goods or trade documents of goods;

5.2 The use of the Mascots in services;

5.3 The use of the Mascots in advertising, commercial exhibition, profit-making performance and other commercial activities;

5.4 The use of the Mascots in selling, importing or exporting goods bearing the Mascots;

5.5 Manufacturing or selling the Mascots; and

5.6 Other acts of using the Mascots that might mislead people to think there are sponsorship or other supporting relations between the doers and this Committee.

6. The use of the Mascots for non-commercial purposes must be explicitly distinguished from commercial activities. No enterprises (excluding participants in the Sponsor Program of the Beijing 2008 Olympic Marketing Plan) or operators are allowed to be provided with business opportunities or advertising publicity, or locate the use adjacent to commercial advertisements.

7. In accordance with the Patent Law of the People s Republic of China (in particular the provisions of Articles Five and 23), and Rules on the Examination of the Application for the Patent of the External Design of Olympic Symbols stipulated by the Patent Office under the State Intellectual Property Office of the People s Republic of China, in the application for patent(s), no organization or individual may be in conflict with the lawful rights obtained priorly by this Committee in relation with the Mascots.

8. In the application to the relevant authorities for the registration of domain name and other rights, no organization or individual may be in conflict with the lawful rights obtained priorly by this Committee in relation with the Mascots.

9. Under any circumstances, organizations and individuals should uphold the legitimacy and seriousness of the Mascots, and must not misrepresent or tamper with the Mascots. The user of the Mascots should adhere strictly to the Mascots-related technical standards and other standardized documentations.

10. In addition to adhering strictly to the Regulations on the Protection of Olympic Symbols, the user of the Mascots within the administrative region of Beijing should also adhere to the Rules of Beijing Municipality Concerning the Protection of Olympic-Related Intellectual Property Rights.

11. Upon discovery of any infringement on the intellectual property rights of the Mascots, this Committee will call on relevant authorities to look into the matter and deal with it according to law and define the responsibilities of the infringer(s).

12. This Committee welcomes any organization or individual to report infringement of the intellectual property rights of the Mascots. For infringement reporting, please contact us at
