The Supreme People's Court of China is making greater efforts to crack down on illegal fund-raising, according to judicial interpretations released Tuesday that clarify crimes applicable to illegal fundraising activities, Xinhua reported. The judicial interpretations took effect on Jan. 4. 据新华社报道,周二,最高人民法院发布了关于非法集资刑事案件具体应用法律问题的解释,标志着高法在打击非法集资案件问题上加大了力度。此司法解释自当日起生效。
According to the interpretations, unauthorized funding from the public and issuing stocks and corporate bonds to the public shall both be treated as criminal offenses. Further, unauthorized fundraisings publicized by various promotions, including through the media and that promises the return of both the principal and interest, will be regarded as crimes. 根据《解释》,未经授权,从公众吸收集资和面向公众发售股票、公司债券等行为将视作犯罪。此外,未经许可,通过包括传媒在内等多种推介手段吸收公众存款,期满后本息并还等行为也将以犯罪来对待。
China has over past years seen rampant illegal fundraising. The money raised through illegal means has increased by 20 billion yuan each year, according to official figures. According to the Ministry of Public Security, police since 2008 have uncovered some 5,000 cases of illegal fundraising, arrested some 5,400 suspects and retrieved 12.2 billion yuan.

我国在过去几年里非法集资揽储现象猖獗。官方数据显示,我国非法集资款项目前以年均200亿元的幅度增长。据公安部消息,自2008年起,全国公安机关共破获5000起左右非法集资案件,涉案嫌犯约5400人,追回资金122亿元。
